With the January 1, 2023, electronic filing requirements mandated by Public Act 102-1019, will I lose a previously allowed discount if I file a paper Form ST-556-X or ST-556-LSE-X on or after January 1, 2023?

Forms ST-556-X and ST-556-LSE-X filed on paper on or after January 1, 2023, to correct a return filed before January 1, 2023, will not cause a previously allowed discount or retailer’s allowance to be removed.

However, on or after, January 1, 2023, if an original Form ST-556 or ST-556-LSE is filed electronically using MyTax Illinois, then any ST-556-X or ST-556-LSE-X must also be filed electronically through MyTax Illinois.

If the original Form ST-556 was filed electronically using an approved service provider in the Electronic Registration and Title Program (ERT) or was filed using a preprinted form, you need to file a paper Form ST-556-X to make changes to the original Form ST-556.

Note: If a taxpayer files a claim for credit and the credit is approved with the 1.75% discount allowed for the approved amount, but the Illinois Department of Revenue subsequently determines that all or any part of the credit taken was not actually due to the taxpayer, the taxpayer’s 1.75% discount will be reduced by 1.75% of the difference between the credit taken and credit due, and that taxpayer will be liable for penalties and interest on the difference. 35 ILCS 120/3; 35 ILCS 105/9.
